Acceptance of these terms

These Terms & Conditions apply to your use of the The Fluent Hāfidh website and to any digital products or resources you buy or download from us. By using the site, joining our email list, or making a purchase, you confirm that you accept these terms and agree to follow them.

If you do not agree with any part of these terms, please do not use the site or buy our products. Please read them alongside our Privacy Policy, which explains how we handle your information.

About us

The Fluent Hāfidh is a UK-based business selling digital products and downloadable resources that help students protect and strengthen their Qur'an memorisation. The website is operated using the Shopify platform.

Eligibility

To buy from us or enter into a contract with us, you must be at least 18 years old, or have the permission of a parent or guardian who agrees to these terms on your behalf. By placing an order you confirm that the information you give us is accurate and that you're able to enter into a binding agreement.

Our digital products

We sell digital products and downloadable resources only - there are no physical goods and nothing is shipped to you. Products may include downloadable guides, worksheets, templates and similar digital materials.

Once your payment is confirmed, your product is delivered digitally - for example, as a download link or access provided through our store or by email. It's your responsibility to download and save your files; we recommend keeping a personal backup.

We describe our products as accurately as we can. Small differences in formatting may appear depending on the device or software you use to open a file. If a product is not as described, please contact us.

Orders & payment

When you place an order, you're making an offer to buy a product. Your order is accepted once we confirm it and provide access to the product. Prices are shown at checkout in GBP (£) and include any applicable taxes where required.

Payments are processed securely by Shopify Payments. We do not see or store your full card details. By placing an order you confirm that you're authorised to use the payment method provided.

We reserve the right to refuse or cancel an order in reasonable circumstances - for example, if a product was listed at an incorrect price due to an error, or if we suspect fraudulent or prohibited use.

Cancellations & refunds

Because our products are digital and delivered immediately, your legal right to cancel within 14 days (under the UK Consumer Contracts Regulations) does not apply once you have started downloading or accessing the product and have agreed to waive that right at checkout.

Your licence to use our products

When you buy a digital product, we grant you a personal, non-exclusive, non-transferable licence to use it for your own personal, non-commercial study. You own the licence to use the product - you do not own the intellectual property in it.

Unless we give written permission, you may not:

• Resell, share, sublicense, rent or redistribute the product to others.
• Upload it to any public or shared platform, or make it freely available.
• Copy, reproduce or republish it beyond your own personal use.
• Use it for any commercial purpose or to create competing products.

Intellectual property

All content on this website and in our products - including text, designs, graphics, logos, the wordmark, and the layout of our resources - is owned by The Fluent Hāfidh or used with permission, and is protected by copyright and other intellectual-property rights.

Qur'anic text and established scholarly material are, of course, not owned by us; our rights apply to our own original content, arrangement and presentation. You may not use our branding or content without our written permission, except as allowed by these terms.

Prohibited use

You agree to use the site and our products lawfully and respectfully. You must not:

• Use the site in any way that breaks the law or infringes someone else's rights.
• Attempt to gain unauthorised access to the site, its systems or another user's data.
• Introduce viruses, malware or anything harmful, or disrupt the site's operation.
• Copy, scrape or misuse our content, or use it to build a competing service.
• Misrepresent your identity or provide false information when ordering.

We may suspend or restrict access if we reasonably believe these terms are being broken.

The Revision Health Assessment

Our Revision Health Assessment is a free self-assessment tool designed to give you general guidance about your memorisation revision. It is provided for information and educational purposes only.

The result is based on the answers you give and is not a professional, religious or educational ruling. It's a starting point to help you reflect - not a guarantee of any particular outcome. You remain responsible for how you act on it.

Email list & waiting lists

You can join our email list or a waiting list for upcoming products. By subscribing you agree to receive emails from us, and you can unsubscribe at any time using the link in any email. How we handle your email address is explained in our Privacy Policy.

Joining a waiting list does not guarantee that a product will launch, that it will launch by a particular date, or that it will be offered at a particular price. Waiting lists simply let us tell you when something is ready.

Coaching & future services

We may offer additional services in the future, such as coaching. These are not currently available. When we launch any new service, specific terms (including price, what's included, cancellation and any additional conditions) will be provided at that time and will apply alongside these terms.

Disclaimer

Our products and content are provided to support your own study and effort. While we prepare them carefully, we don't promise any specific result - memorisation and revision outcomes depend on your own consistency and circumstances.

The site and its content are provided "as is". To the extent permitted by law, we don't give any guarantees that the site will always be available, uninterrupted or error-free, or that the content is complete or suitable for a particular purpose.

Limitation of liability

Nothing in these terms limits or excludes our liability where it would be unlawful to do so - including liability for death or personal injury caused by negligence, or for fraud. Your statutory rights as a consumer are not affected.

Subject to that, we are not liable for any indirect or consequential loss, or for loss that was not reasonably foreseeable, arising from your use of the site or our products. Where we are liable, our total liability to you will not exceed the amount you paid us for the relevant product.

Privacy

We take your privacy seriously. Our Privacy Policy explains what personal information we collect, how we use it, and the rights you have. By using the site you agree to the practices described there.

Third-party links

Our site and emails may link to other websites and to our Instagram page (@thefluenthafidh). We provide these links for convenience and are not responsible for the content, products or practices of third-party sites. Visiting them is at your own risk and subject to their own terms.

Changes to these terms

We may update these terms from time to time - for example, when we add new products or services. When we do, we'll change the "Last updated" date at the top of this page. The version in force at the time you place an order is the one that applies to that order. Please check back occasionally so you're aware of any changes.

Governing law

These terms are governed by the laws of England and Wales, and any disputes will be subject to the courts of England and Wales. If you are a consumer, you may also benefit from any mandatory protections of the country in which you live.
